Terms of Service

1. Acceptance of Terms
By accessing or using the Ionic Group website (ionic-group.ca) or placing an order with us, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.
These Terms constitute a binding legal agreement between you and Ionic Group. We reserve the right to update or modify these Terms at any time, and your continued use of our site following any changes constitutes your acceptance of the revised Terms.
2. Eligibility
You must be at least 18 years of age to use our services or make a purchase. By using our site, you represent and warrant that you meet this requirement and that all information you provide is accurate, current, and complete.
3. Products and Pricing
We reserve the right to modify, discontinue, or remove any product from our catalog at any time without notice. All product descriptions, images, and specifications are provided in good faith and are subject to change.
All prices are listed in Canadian dollars (CAD) and are inclusive of applicable taxes unless otherwise stated. We reserve the right to correct pricing errors at any time. In the event a product is listed at an incorrect price, we will notify you prior to processing your order and give you the option to proceed at the correct price or cancel.
4. Orders and Payment
Placing an order constitutes an offer to purchase. We reserve the right to accept or decline any order for any reason, including but not limited to product availability, suspected fraud, or errors in pricing.
Payment is required at the time of order. We accept major credit cards and other payment methods as displayed at checkout. All payment information is processed securely by our payment provider (Stripe) and is subject to their terms and privacy policy.
We reserve the right to cancel any order if payment cannot be verified or is suspected of being fraudulent. If your order is cancelled, you will receive a full refund to your original payment method.
5. Shipping and Delivery
We ship within Canada. Estimated delivery times are provided at checkout and are approximations only — actual delivery times may vary due to carrier delays, weather, or other factors outside our control.
Title and risk of loss for products pass to you upon delivery to the shipping carrier. Ionic Group is not liable for delays, damage, or loss caused by third-party carriers after the order has been dispatched.
Shipping charges are calculated at checkout and are non-refundable unless the return is due to our error.
6. Returns and Refunds
We want you to be satisfied with your purchase. If you are not completely happy with an item, you may request a return within 30 days of receipt, provided the item is:
- In its original, unused condition.
- In its original packaging with all accessories and documentation.
- Not a final sale or non-returnable item as designated at the time of purchase.
To initiate a return, please contact us at support@ionic-group.ca with your order number and reason for return. We will provide return shipping instructions. Return shipping costs are the responsibility of the customer unless the return is due to a defect or our error.
Refunds will be issued to your original payment method within 5–10 business days of our receipt and inspection of the returned item. We reserve the right to deny a refund if the item is returned in a condition inconsistent with these requirements.
7. Warranties and Disclaimers
Products are sold "as described". We make reasonable efforts to ensure product descriptions and images are accurate, but we do not warrant that descriptions are error-free, complete, or current.
To the fullest extent permitted by applicable law, Ionic Group disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose.
Nothing in these Terms limits or excludes any rights you may have under the Consumer Protection Act, 2002 (Ontario) or other applicable Canadian consumer protection legislation.
8. Limitation of Liability
To the maximum extent permitted by law, Ionic Group and its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services or products, including but not limited to loss of profits, data, or goodwill.
In no event shall our total liability to you exceed the amount you paid for the specific order giving rise to the claim.
9. Intellectual Property
All content on this website — including text, graphics, logos, images, and software — is the property of Ionic Group or its content suppliers and is protected by Canadian and international copyright and trademark laws.
You may not reproduce, distribute, modify, or create derivative works from any content on this site without our prior written consent.
10. User Accounts
If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately at support@ionic-group.ca if you suspect any unauthorised use of your account.
We reserve the right to suspend or terminate any account at our discretion, including for breach of these Terms or suspected fraudulent activity.
11. Privacy
Your use of our services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our site, you consent to the collection and use of your information as described in that policy.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada and the federal laws of Canada applicable therein, without regard to conflict of law principles.
Any disputes arising from or relating to these Terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of Ontario, Canada.
13. Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it enforceable.
